Looking for expert legal advice?

Leading Court of Protection Solicitors in Reading, Henley-on-Thames & Wokingham

We understand that every Court of Protection case is unique and can advise on all aspects, ranging from applying to have a deputy appointed to putting in place necessary care arrangements. Different court powers will apply depending on how substantial the individual’s assets are when they become incapable.

You will be searching for a specialist solicitor who can help to ensure that you and your family’s immediate and longer-term interests are protected. Listening carefully to your needs and aims, we are committed to providing you with clear and effective legal advice, an understanding and supportive service and, crucially, value for money, alongside the peace of mind that comes with knowing matters are being taken care of.

Although based in Berkshire, we have been appointed as deputies and attorneys by clients living in surrounding counties, including Oxfordshire, Buckinghamshire, Hampshire, Surrey, Sussex and Wiltshire.

Working With our Leading Team of Court of Protection Solicitors

The Court of Protection, based in London, exists to deal with all issues relating to those who unfortunately lack mental capacity to make decisions themselves. Our specialist Court of Protection solicitors can assist you if somebody close to you requires the help of the Court of Protection; for example, a mental health issue, learning disability, brain injury or illness.

Part of the role of the Court of Protection is to help protect and manage the property and financial affairs of people with mental incapacity to prevent them from being exploited or denied what is rightfully theirs. This can include situations where there are no family or friends to take on such a responsibility and cases where there may be a family dispute, a financial issue or where Social Services are involved. It can also include complex cases that relatives are not willing or able to deal with.

Court of Protection cases are normally heard by district judges and a senior judge, but in some cases may be heard by High Court judges. Cases can sometimes be transferred to a local court for a hearing.

Trusted Expertise & Experience in Court of Protection Matters

Having marked our 290th anniversary in 2023, clients continue to trust in our expertise and significant experience. We are proud of the fact that many of our clients stay with us throughout their lifetimes and to have acted for a growing number of families across generations.

Our solicitors are members of and/or accredited by leading professional bodies, including the Society of Trust and Estate Practitioners (STEP) and The Association of Lifetime Lawyers (formerly Solicitors for the Elderly), whilst colleagues have also completed training to become Dementia Friends, in conjunction with the Alzheimer's Society.

We are one of only two firms in Reading and the only firm in Henley-on-Thames or Wokingham to be recognised as a top tier firm of private client solicitors in both of the UK’s leading guides to law firms, Chambers HNW and The Legal 500. Our successful approach is further reflected in the excellent client feedback we continue to receive.

We enjoy excellent relationships with other leading professional services firms across the region and are experienced in working closely with other authorities, agencies and advisers who may be supporting you. This can help to ensure a smoother process and to minimise the likelihood and impact of any unforeseen issues or costly delays. You can also rely on colleagues within our firm for specialist expertise in other areas if required, including property and advice in relation to any business interests.
