Telecommunications leases

In an age of ever increasing reliance on telecommunications, operators are constantly looking for sites upon which to locate their masts and other apparatus. This will often be on rooftops, in fields or on unused pieces of land. If you are an owner who wishes to enter into a lease with an operator to allow location of apparatus on your property or if you are renewing an existing lease, we can assist. It is important to take independent legal advice even in relation to a renewal as the leases give operators extensive statutory rights which it is important that landowners understand.

We are experienced in dealing with telecommunications leases whether rooftop or land based and can steer you through the complexities of the new Telecommunications Code 2017 (“the Code”). We are able to advise you on the long term implications of entering into such leases. We often work with, and are recommended by surveyors who negotiate these leases on behalf of land owners. As such, we are familiar with the forms of leases used by some of the larger operators and have worked with the solicitors they use. This can often lead to a more efficient process.

Our Dispute Resolution team is able to advise on exercising rights under the Code should you wish to end the lease or require removal of the apparatus.

Solar panel leases

We are being encouraged to rely more on renewable energy and solar panels, particular in the form of solar panel farms are becoming more common. Landowners, particularly farmers, are finding that they have land which they cannot use which would be perfect for solar panel farms and which will bring in much appreciated additional income.
